Fantasy Gambling — Privacy Policy

This Privacy Policy explains how the operator of Fantasy Gambling (“Operator,” “we,” “us”) collects, uses, and shares information when you use misconin.com, fantasy.misconin.com, and related emails and forms (the “Service”).

The Operator is the person or persons who operate the Service under the Fantasy Gambling name, together with any later-formed entity or successor that assumes operation.

This Policy is part of the Terms of Service. Words we define there have the same meaning here.

We run a small, free product. We are not in the business of selling your information.


1. Who this is for

The Service is for people 21 or older. We do not knowingly collect personal information from anyone under 21, and we do not direct the Service at children under 13. If we learn we have information about a person under 21, we will delete the account and related personal information when we can, except where we must keep a record (for example, a ban so they cannot immediately sign up again).


2. Information we collect

2.1 You give us

  • Email address — required to sign in (magic link). Also if you put it on a feedback form.
  • Display name — what other players see. Do not put your legal name or email in it if you do not want that shown.
  • Timezone — so we can show kickoff times in your local time. NFL week bounds still run on Eastern time.
  • Preferences — for example simple vs full board, global-board opt-out, auto-join next open season.
  • Feedback — name, optional email, and message if you use the marketing-site form.
  • Pool and play data you create — tickets, stakes, reactions, pool memberships, commissioner settings if you create a pool, and Locker Talk messages in a closed pool you belong to.
  • Age and terms confirmation — a checkbox that you are 21 or older and agree to the Terms and Privacy Policy. We store the time you checked it, which document versions you agreed to, and which screen you were on. We do not collect your date of birth, a government ID, or a password.

2.2 We create when you play

  • Account identifiers and timestamps.
  • Session records (so you stay signed in).
  • Credit ledger entries, standings math, badges, matchup results.
  • Sign-in tokens and their expiry.
  • Operational logs (errors, security, abuse).

2.3 Device and usage

  • App / site technical data: IP address, user-agent, approximate device type, pages requested, and similar server-log data our hosts collect to deliver the site.
  • Marketing-site counts: the landing site may record page views and button clicks as counts plus a coarse device type (mobile vs desktop) and a path. That pipe is for our own traffic math. It is not an advertising pixel and it is not tied to your account.
  • Product-mail clicks: when a product email includes a link, we may send that click through our site first and add one to a count for that list and button (for example weekly mail → open the board). We do not store who clicked. This is not an open-tracking pixel and it is not an advertising pixel.
  • Cookies and similar: we use necessary cookies or cookie-like storage for sign-in and session. We do not currently use advertising cookies or sell access to your data for cross-context ads.

2.4 We do not collect (today)

  • Payment information (there is nothing to pay).
  • Precise GPS.
  • Contacts, photos, or microphone.
  • Third-party advertising profiles.

If that list changes, this Policy should change first.


3. How we use information

We use the information above to:

  • create and secure your account, send sign-in links, and keep you signed in;
  • operate pools, tickets, settlement, standings, badges, in-app announcements, and Locker Talk in closed pools;
  • show other players what the product is designed to show (names, tickets, boards);
  • email weekly or transactional product mail related to a pool you joined;
  • respond to feedback and fix scoring or product bugs;
  • protect the Service (fraud, underage use, abuse, security);
  • send operations alerts to ourselves when someone new signs up or something breaks;
  • comply with law and enforce the Terms;
  • understand, in aggregate, whether anyone is using the landing pages and which product-mail links are used.

We do not use your information to price a cash wager, to run a credit check, or to sell you a sportsbook account.


4. Who else can see it

4.1 Other users

People in your pools — and, unless you opt out where we offer it, people who can see an open or global board — can see your display name, tickets, results, and similar play data. Members of a closed pool can also see Locker Talk messages posted in that pool. They cannot see your email from the product UI.

If you put personal information in a display name, a Locker Talk message, or a ticket-facing field, other people will see it. That is on you.

Commissioners can take actions that affect your in-app record (voids, pool settings). They still do not get your email from us except if you gave it to them outside the Service.

4.2 Service providers

We share information with vendors who help us run the Service, only as needed for that job:

  • Email delivery (sign-in links, product mail, feedback routing).
  • Hosting, storage, and content delivery for the marketing site and the app.
  • Operations alerting — a messaging service used to tell us that an account was created. That alert may include your email address.
  • Professional advisers (lawyer, accountant) if we have a real need.

Those vendors process information on our instructions or as their own controllers for their slice (for example, an email provider’s abuse logs). We do not authorize them to sell your information.

4.3 Legal and safety

We may disclose information if we believe it is required by law, valid legal process, or a government request; to protect us, you, or others; or in connection with a merger, LLC formation, or transfer of the Service (the next operator will be bound to this Policy or a successor policy that is not materially less protective without notice).

4.4 We do not sell personal information

We do not sell personal information and we do not share it for cross-context behavioral advertising as those words are used in California or Colorado privacy statutes.


5. Retention

We keep account and play records for as long as the account is open and as long as we need them for standings, security, dispute context, backups, and legal obligations.

If you ask us to delete your account, we will delete or de-identify personal information we do not need to keep. We may retain:

  • records we must keep for law, security, or to prevent a banned user from immediately returning;
  • de-identified or aggregated play statistics;
  • backups for a limited rotation period;
  • content that has been shown to other users in a form that is unreasonable to rewrite (for example, a historical standings row may become “Deleted user”).

Off-platform money you arranged with friends is not our data. Deleting your account does not delete anyone’s Venmo history.


6. Security

We use reasonable measures for a small service (access controls, session expiry, limited admin access). No method of transmission or storage is fully secure. Magic-link sign-in is only as strong as your email account. You accept that residual risk by using the Service. See also Terms §14 and §16.

If we become aware of a breach that Colorado or other applicable law requires us to notify, we will notify you and regulators as required, using the email on your account when we can.


7. Your choices

  • Display name, timezone, board visibility, season auto-join, betting style — in Settings, when signed in.
  • Email: you cannot use the app without an email. You can stop using the Service and ask us to delete the account.
  • Product mail: ask us at legal@misconin.com if a control is missing. Sign-in and legal notices will still go to that inbox while the account exists.
  • Cookies: you can block cookies in your browser. The app will not stay signed in.

8. Access, correction, deletion

Email legal@misconin.com from the address on your account and say what you want: a copy of the personal information we have, a correction, or deletion.

We will need to verify it is you. We will respond within a reasonable time (and within any deadline a law that actually applies to us imposes).

We may decline requests that are unfounded, excessive, would break another user’s privacy, or that we are allowed to refuse.


9. State privacy laws (Colorado, California, and others)

Some U.S. state privacy laws (including the Colorado Privacy Act) apply only if a business meets size or data-sale thresholds we do not currently meet. We still describe our practices in this Policy and we will honor the requests in §8 as a matter of policy.

If a law later applies to us, you may also have rights to appeal a denial, to opt out of targeted advertising, sale, or certain profiling, and to designate an authorized agent. We will update this Policy if that happens. We do not do those things today in a way that would require a “Do Not Sell or Share” control.

Colorado residents: you may contact the Colorado Attorney General if you have a complaint about a privacy law that applies. That is not an admission that the CPA applies to us now.

International visitors: we operate from the United States. If you use the Service from elsewhere, you transfer information to the U.S. and you do so at your own risk. The Service is not intended to comply with the GDPR as an EU-offered service. If you are in the EEA, UK, or Switzerland, do not use the Service.


10. Third-party links and sports data

The Service may show team names, scores, and lines that originate from third-party data sources. Those sources have their own practices. A link to another site is not our Policy covering that site.


11. Changes

We may change this Policy. We will update the date at the top. If we have your email, we may also notify you of a material change. Continued use after the new date is acceptance, except where the law requires a different method of consent.
